Section 301 Tariff Exclusions Exted or Granted for Medical Goods

Exclusions from the Section 301 additional tariffs on imports from China are being exted for 80 medical care products needed to address the COVID-19 pandemic and newly granted for an additional 19 such goods. These exclusions are available for any product that meets the specified HTSUS numbers and product descriptions, regardless of whether the importer filed an exclusion request. However, the exclusions are only valid from Jan. 1 through March 31. As a result, affected companies should continue to push for permanent extensions under the new Congress (which is seated Jan. 5) and the administration of President-elect Biden (who will be inaugurated Jan. 20). A recent report from the International Trade Commission may be used to substantiate the need for a longer continuation of these exclusions. Among other things, the ITC found that U.S. producers of COVID-19-related goods faced challenges in ramping up production to meet growing demand and that imports increased substantially as a result.
